FaceJoin.Community Rules

 

This user's agreement (further – “Agreement”) regulates relationship between administration of service  "FaceJoin.Community" (further – “Administration”) and physical person (further – “Author”)in distribution of photo, video, audio, flash games and article files (further – “Files”), textmessages at WEB-site in Internet on address FaceJoin.Community (further – “Site”)  Author is considered a physical person, who hasjoined to this Agreement in order and has directed one or few photo, video, audio, flash games and article files or text messages for distribution at the Site.

 

1. Author gives to the Administration Files or text messages for placing on the Site on terms, defined by this Agreement.

2. Text of the Agreement is shown to Author during uploading process to the Site. The Agreementcomes into effect after Author agrees to its conditions. Author mustpush the button “Accept Users’ Agreement conditions” duringregistration. The Administration accepts placing Files and textmessages only after Author has joined to this Agreement.

3. Conditions for placing photo, video, audio, flash games and article files files on FaceJoin.Community

  • 3.1. Administration places photo, video, audio, flash games and article files on the Site, if the Filescorrespond to technical parameters indicated in this Agreement.
  • 3.2. There is no recompense for Authors for uploaded media files, because our project FaceJoin.Community is a free service.
  • 3.3. The Author, that has joined to this Agreement and has uploaded mediaFiles for placing on the Site, transfers his rights on the media forfree usage and wide access to them (subject to restrictions for access,regulated in p. 3.7) in limit of this web-resource without anyrecompense. Author agrees, that Administration has a right todistribute advertising banners and advertisements at web-pages withAuthor’s media and modify media Files for advertising purposes, alsoAdministration has a right to use uploaded Files in other commercialpurposes.
  • 3.4. It’s the Author’s responsibility for placing restricted media materials on the site.
  • 3.5. Until the other rights are not established, all personal rights ofproperty and non-property rights to File belong to the Author who hasuploaded it. Author is warned about responsibility for illegal usageand distribution. If it is established that Author doesn’t have aright for a certain media File, this file will be deleted from the siteafter the first demand of legal right possessor.
  • 3.6. Administration indicates Author’s nickname on the viewer’s interface, which the Author indicates during the Files upload.
  • 3.7.We do not place Files that contain:

-materials, that are illegal, harmful, threatening, morally abusive,honor and dignity, rights and registered interests of foreigners,slanderous, pirated, propaganda of hatred and/or racial, ethnic, sex,social discrimination, promotional kindling a religious, racial orinternational discord, containing violence scenes or inhumane treatmentof animals, etc. ;

- infringement of minority right;

- presentation as an other person or representative of organizationand/or community without enough rights, including employees of FaceJoin.Community, owner of FaceJoin.Community,  and also false representation of  qualities and description of any subjects and objects;
- materials, that User doesn’t have a right to make accessible according to legislation or any contracts;

- materials, that affect any patents, trade marks, trade secrets,copyrights or other rights of property and/or intellectual propertyrights or adjoining with it of a foreigner;

- special advertising information is not allowed: spam,  “pyramid” schemes, “letters of happiness”;

- materials, containing computer codes, intended for hacking,destruction or limitation of functionality of any computer ortelecommunicational equipment or programs, for unapproved access, andcommercial program products serial number, logins, passwords, and othermeans for unapproved access to commercial Internet resources;

- special or casual destruction of any local, state or international laws;

- gaining and keeping personal dates about other users;

- uncoordinated transmission of advertising, commercial and agitation records;

- drugs advertisement;

- records addressed to somebody containing rude and abusive expressions and propositions;

- records containing pornography.

  • 3.8. Administration have a right to refuse the Author in placing Files andtext messages, also delete Files if their contents contradict thedemands of this Agreement. At the same time Administration doesn’t haveto inform Author about reasons of such refuse.
  • 3.9. Administration tries hard to ensure the regular work of Site, butdoesn’t respond for full or particular lose of Files, distributed byAuthor, and also for insufficient quality and speed of serviceaccordance.
  • 3.10. Author agrees to responsibility forFiles, uploaded by him to the Site. Administration doesn’t respond forFiles content and their correspondence to legislation, for infringementof copyrights, unapproved usage of trade marks, company names and theirlogos, and also for possible infringement of rights of foreignersbecause of distribution of Files at the Site. If the official ownerhave claims for placing Files, Author will satisfy this claimsindependently at his own expense.

4. Technical demands to Files

  • 4.1. If Author sends Files under the technical demands indicated in thispoint, Files will be placed to the Site. Administration has a right notto distribute the File, if it doesn’t correspond to these demands.
  • 4.2. Video file must be in one of the wide-spread formats (Windows Media Video,Apple QuickTime, MPEG 1-4, DivX, XviD, 3gp, Flash Video).
  • 4.3. Photo files must be in one of the wide-spread formats (Jpeg, Jpg, Png, Gif)
  • 4.4. Audio files must be in one of the wide-spread formats (mp3, wma)
  • 4.4. Game files must be in Flash based format (swf)
  • 4.5. Files are placed to the Site by uploading by user’s interface “UPLOAD”

5. The Agreement is a legally binding contract between Author and Administration. Itregulates conditions of Author’s Files placement to the Site.

6. If Author consider his rights are infringed because of Administrationor a foreigner has placed a media File to the Site, the Owner shouldsend his claim to support@facejoin.com or using online contact from. File will be immediately seized from free access at the first demand of legal right owner.

7. Administration may change this actual Users Agreement without any special announcement.
